All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

  1. Intellectual Property Rights:

    Unless otherwise stated, Vivid Lens and/or its licensors own the intellectual property rights for all material on Vivid Lens. All intellectual property rights are reserved. You may view and/or print pages from https://www.vividlens.com for your own personal use subject to restrictions set in these terms and conditions.

    You must not:

    • Sell, rent or sub-license material from https://www.vividlens.com

  2. License to Use Photographs:

    Upon full payment for services rendered, Vivid Lens grants the client a perpetual, non-exclusive license to use the photographs for personal and commercial purposes, including but not limited to advertising, marketing, and promotional materials. The client may not resell the photographs or use them in a manner that infringes upon the rights of any third party.

  3. Payment Terms:

    Payment for photography services is due as specified in the invoice provided by Vivid Lens. A deposit may be required to secure the booking, with the remaining balance due upon completion of the services. Late payments may be subject to interest charges. Vivid Lens reserves the right to withhold final images until full payment is received.

  4. Cancellation and Rescheduling:

    If the client cancels a scheduled photography session, the deposit may be non-refundable, depending on the timing of the cancellation. Vivid Lens will make reasonable efforts to reschedule the session, subject to availability. If Vivid Lens cancels the session due to unforeseen circumstances, the client will receive a full refund of any payments made.

  5. Limitation of Liability:

    Vivid Lens is not liable for any indirect, special, or consequential damages arising out of or in connection with the photography services provided, including but not limited to loss of profits, loss of data, or business interruption. Our liability is limited to the amount paid by the client for the services.

  6. Client Responsibilities:

    The client is responsible for obtaining any necessary permissions or releases for photographing individuals or properties. The client must also provide a safe and suitable environment for the photography session. Vivid Lens is not responsible for any issues arising from the client’s failure to meet these responsibilities.

  7. Privacy:

    We are committed to protecting your privacy. Authorized employees within the company on a need to know basis only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers. Please refer to our Privacy Policy for more details.

  8. Cookies:

    Like most interactive web sites Vivid Lens uses cookies to enable us to retrieve user details for each visit. Cookies are used in some areas of our site to enable the functionality of this area and ease of use for those people visiting. Some of our affiliate partners may also use cookies.
